Terms of Service

Effective November 1, 2026 · These terms apply to yarkade.com, play.yarkade.com and the games on Yarkade, including Nitro Burst.

1. Who we are

Yarkade is operated by HG Technologies, LLC, a Colorado limited liability company ("we", "us"). Contact: hello@yarkade.com.

2. Using Yarkade

Anyone can play with a nickname. Children under 18 need a parent or guardian's permission to use Yarkade, and a parent or guardian must confirm their email before a child can save a racer across devices, join a team, or make a purchase. Parents are responsible for supervising their child's use.

3. Play fair and be kind

• Pick a nickname that is friendly and is not your real full name. No rude, hateful or personal-information names.
• Don't cheat, hack, use bots or scripts, exploit bugs, or try to access other players' accounts.
• Don't try to slow down or break the service.
• Don't pressure or trick other players in trades.

We may change nicknames, remove content, or suspend players who break these rules.

4. Points, cars and other virtual items

Points, cars, built cars, upgrades and other in-game items are part of the game. They have no cash value, cannot be exchanged for real money, and are licensed to you for use in Yarkade; you don't own them. We may change, rebalance or reset the game economy (for example, prices or car stats) to keep games fair and fun. Trades between players are final once both players confirm.

5. Purchases

Purchases require a parent or guardian with a confirmed email. While Yarkade is in testing, purchase screens are marked as test mode and no money is charged. When real purchases are offered, prices and refund terms will be shown before you buy, and payments will be handled by a payment processor.

6. Screen time

Yarkade may limit daily play and building time by default. Parents can adjust limits within the maximums we set.

7. Games and ideas you create

When Yarkade lets you create games, the ideas you describe and the games built from them are yours to enjoy and share on Yarkade. By publishing a game, you give us permission to host, show and promote it on Yarkade. Don't publish anything that copies someone else's characters, brands or games, or that isn't suitable for kids. We review games before they are published.

8. Our content

Yarkade, Nitro Burst, their designs, code, artwork and names belong to us or our licensors. Please don't copy or reuse them outside Yarkade without permission.

9. Changes and availability

Yarkade is new and changes often. Features may change or end, and the service may sometimes be unavailable. We may update these terms; if a change is important, we will tell parents who have given us their email. Continuing to use Yarkade means you accept the updated terms.

10. Disclaimers and limits

Yarkade is provided "as is" and "as available". To the fullest extent allowed by law, we are not liable for indirect or consequential losses, or for loss of virtual items, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (or $10 if you paid nothing). Some places don't allow these limits, so they may not apply to you.

11. Ending use

You can stop using Yarkade at any time, and parents can ask us to delete their child's data (see the Privacy Policy). We may suspend or close access for players who break these terms.

12. Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules.
